Game End User License Agreement

1. Agreement to License

This End User License Agreement ("EULA") is a binding agreement between you ("Player," "you") and KillerRocks LLC ("KillerRocks," "we," "us") governing your use of the Rock Hunt and KR Gold Rush browser games (collectively, "the Games"), including all game clients, server software, virtual items, virtual currency, characters, saves, and related content. This EULA supplements and is incorporated into the KillerRocks Terms of Service; in the event of a direct conflict specific to the Games, this EULA controls. By clicking "I Agree" or by accessing or playing the Games in any way, you accept this EULA in full. If you do not agree, do not play.

2. Eligibility

You must be at least 18 years of age and hold a valid, active KillerRocks account in good standing to play the Games, consistent with the eligibility requirements of the Terms of Service. Accounts found to belong to a minor will be permanently suspended.

3. License Grant

Subject to your compliance with this EULA, KillerRocks grants you a limited, personal, non-exclusive, non-transferable, non-sublicensable, revocable license to access and play the Games for your own non-commercial entertainment. This license does not grant you any ownership interest in the Games or any content within them. All rights not expressly granted are reserved by KillerRocks.

You may NOT: (a) copy, decompile, reverse-engineer, disassemble, or attempt to derive the source code of the Games; (b) modify, create derivative works of, or build competing products from the Games; (c) remove or alter any proprietary notices; (d) use the Games for any commercial purpose, including streaming for direct monetary gain that implies KillerRocks endorsement without our written consent; (e) operate a private server, emulator, or proxy of the Games; or (f) sublicense, rent, lease, or transfer your access to any third party.

4. Ownership of Game Content

All title, ownership rights, and intellectual property rights in and to the Games — including but not limited to code, art, audio, character designs, world design, item names and descriptions, the Rock Hunt and KR Gold Rush names and logos, and all derivative works — are and remain the exclusive property of KillerRocks LLC and its licensors. The Games are protected by United States and international copyright, trademark, and other intellectual property laws.

5. Virtual Items and Virtual Currency — No Ownership, No Real-World Value

KR Coins ("KRC") is a virtual, in-game-only currency used exclusively within the Games. Virtual items include, without limitation, gear, consumables, loot crate contents, crafted equipment, claim parcels, mining equipment, cosmetics, and any other in-game asset.

• License only, not property. KRC and all virtual items are licensed to you, not sold. You have no ownership interest, property right, or title in any virtual currency or virtual item, regardless of whether you obtained it through gameplay or by real-money purchase of a KRC pack.
• No real-world monetary value. KRC and virtual items have no value outside the Games, cannot be redeemed for cash, and are not a substitute for real currency. KRC is never exchangeable for, convertible to, or linked in any way to Forum Gold (KillerRocks' real-money-backed platform currency, governed separately by the Forum Gold Terms). There is no cash-out mechanism for KRC or any other in-game virtual item, under any circumstance.
• No guarantee of availability. KillerRocks does not guarantee that any virtual item or amount of KRC will remain available, unchanged, or accessible for any period of time.
• Right to modify, rebalance, or remove. KillerRocks reserves the right, at its sole discretion and without prior notice or compensation, to modify, rebalance, restrict, remove, wipe, or discontinue any virtual item, currency, game feature, character save, or economy mechanic (including drop rates, crafting costs, KRC pricing, and claim/mining yields).
• Real-money trading (RMT) prohibited. Buying, selling, trading, or transferring KRC, virtual items, game accounts, or game saves for real money or real-world value outside of KillerRocks' own official KRC purchase flow is strictly prohibited and will result in permanent account termination and forfeiture of all virtual items without compensation.

6. Purchases of KR Coin Packs

KR Coin packs may be purchased with real money via Stripe, as described in the Purchase & Billing Terms. All KRC purchases are final and non-refundable once credited to your account, except where required by applicable law or where a technical error resulted in incorrect crediting or a duplicate charge (in which case, contact support@killerrocks.com immediately). No refunds are issued for KRC spent, consumed, or lost through gameplay, account termination, or a game economy change.

7. Client-Authoritative Design, Fair Play & Anti-Cheat Monitoring

The Games are built with client-side game logic; save data you submit is treated as untrusted input and is validated, bounds-checked, and monitored server-side for anomalies (including but not limited to implausible currency gains relative to playtime, out-of-range stats, and save-tampering signatures). By playing, you expressly consent to this monitoring.

You agree NOT to: use bots, macros, scripts, memory editors, packet manipulation, or any other tool to automate or falsify gameplay; exploit bugs for unintended advantage rather than reporting them; edit or tamper with your local save data before it is submitted to our servers; or assist others in doing any of the foregoing. A save or account flagged for suspicious activity may be placed under manual staff review, and KillerRocks may, at its sole discretion, reset, roll back, adjust, or void suspicious currency/progress, suspend, or permanently terminate the account, with no obligation to restore lost progress or issue any compensation.

8. Service Availability, Changes, and Discontinuation

The Games are provided on an "AS IS" and "AS AVAILABLE" basis. KillerRocks does not guarantee uninterrupted, error-free, or continuous availability of the Games. We may suspend, restrict, or discontinue the Games (in whole or in part) at any time, with or without notice, for maintenance, technical issues, business reasons, or any other cause. KillerRocks is not liable for any loss of progress, virtual items, or KRC resulting from downtime, maintenance, data loss, rollback, or discontinuation of the Games.

9. Data Collected Through the Games

In addition to the data described in the general Privacy Policy, playing the Games results in collection of: your save data (level, currency, inventory, progress), gameplay telemetry used for anti-cheat and balance analysis, and IP address/session metadata associated with save submissions. Flagged-save review data may be retained by staff for fraud-prevention purposes beyond normal account data retention windows.

10. Termination and Forfeiture

This license terminates automatically and immediately if you breach this EULA, if your KillerRocks account is suspended or terminated for any reason, or if KillerRocks discontinues the Games. Upon termination, all rights granted to you under this EULA cease, and any KRC balance, virtual items, characters, or progress associated with your account are permanently forfeited with no refund, credit, or compensation of any kind, except as required by applicable law.

11. No Warranty

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE GAMES ARE PROVIDED WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR THAT THE GAMES WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE. NO ADVICE OR INFORMATION, WHETHER ORAL OR WRITTEN, OBTAINED FROM KILLERROCKS OR THROUGH THE GAMES SHALL CREATE ANY WARRANTY NOT EXPRESSLY STATED IN THIS EULA.

12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, KILLERROCKS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE GAMES, INCLUDING LOSS OF VIRTUAL ITEMS, KRC, PROGRESS, OR DATA, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. KILLERROCKS' TOTAL CUMULATIVE LIABILITY ARISING FROM THIS EULA SHALL NOT EXCEED THE TOTAL AMOUNT YOU PAID FOR KR COIN PACKS IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR $50 USD, WHICHEVER IS GREATER.

13. Dispute Resolution & Governing Law

Disputes arising from this EULA are subject to the binding arbitration, class-action waiver, and governing-law provisions of the KillerRocks Terms of Service, which are incorporated here by reference.

14. Changes to this EULA

KillerRocks may modify this EULA at any time. Material changes will be announced in-platform. Continued play after a change constitutes acceptance of the revised EULA. If you do not agree to a change, your sole remedy is to stop playing the Games.
