Marketplace Seller Agreement

1. Seller Responsibilities

• All items must be accurately described including condition, origin, size, weight, and any known defects
• Photos must accurately represent the actual item being sold - stock photos or photos of different specimens are prohibited
• Sellers must have clear legal title to all listed items
• Sellers must ship or complete transfer within the timeframe communicated to the buyer
• Natural specimens must not be misrepresented as something they are not (e.g., glass sold as obsidian, synthetic sold as natural)

2. Prohibited Items

• Stolen or illegally obtained items
• Items protected under ARPA, NHPA, CITES, or equivalent cultural property laws
• Human remains or funerary objects without proper documentation
• Synthetic items presented as natural without clear disclosure
• Any items whose sale is prohibited under applicable federal, state, or local law

3. Listing Rules

• One listing per unique physical item
• Listings may be bumped once per hour maximum
• Listings must remain as posted - material changes require a new listing
• Price manipulation (fake offers from secondary accounts) is strictly prohibited

4. Platform Role

KillerRocks is a venue that facilitates transactions between independent buyers and sellers. KillerRocks is not a party to any transaction, does not hold funds in escrow (unless a future escrow service is explicitly offered), does not guarantee buyer or seller performance, and is not responsible for disputes between users. Users transact at their own risk.

5. Fees

A platform fee of 5% applies to completed marketplace transactions where payment is processed through the Platform. Transactions conducted off-platform are not subject to this fee but are also not covered by any dispute resolution services.

6. Dispute Resolution Between Users

KillerRocks may, at its sole discretion, assist in mediating disputes but is under no obligation to do so. Users are encouraged to resolve disputes directly. Fraudulent sellers may be reported to relevant law enforcement.

7. Seller Indemnification

Sellers agree to indemnify KillerRocks LLC from any claims arising from their listings, sales, or conduct on the Platform, including claims of fraud, misrepresentation, or infringement of third-party rights.

8. Account Consequences

Violation of this Agreement may result in listing removal, account suspension, permanent ban, and/or referral to law enforcement. Reputation scores and seller history are permanently recorded.
