Terms of Service

1. Acceptance of Terms

By accessing or using KillerRocks.com ("the Platform," "we," "us," or "our"), you ("User," "Member," "you") agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms in their entirety, you must immediately discontinue use of the Platform. These Terms constitute a legally binding agreement between you and KillerRocks LLC.

2. Eligibility

You must be at least 18 years of age to use this Platform. By registering, you represent and warrant that you are 18 or older and have the legal capacity to enter into binding contracts. Users under 18 are strictly prohibited.

3. User Accounts

You are responsible for maintaining the confidentiality of your login credentials. You agree to immediately notify KillerRocks of any unauthorized use of your account. KillerRocks reserves the right to suspend or permanently terminate accounts that violate these Terms, at our sole discretion, without prior notice.

4. Marketplace Rules

• One listing per unique item. Duplicate posts will be automatically removed.
• Listings may be bumped once per hour. Circumventing the bump cooldown is prohibited.
• All items listed must be accurately described, legally owned by the seller, and legally transferable.
• Listing stolen, illegally obtained, or protected cultural property is strictly prohibited and may result in criminal referral.
• Items must be as described. Intentional misrepresentation constitutes fraud.
• KillerRocks is a venue only and is not a party to any transaction between users.
• Users are solely responsible for verifying the identity, reputation, and legitimacy of trading partners.

5. Prohibited Content

The following content is strictly prohibited on the Platform:

• Items misrepresented as natural when synthetic or lab-created
• Stolen, looted, or illegally excavated artifacts
• Protected fossils, artifacts, or materials under ARPA, NHPA, or equivalent laws
• Spam, phishing links, or fraudulent listings
• Harassment, hate speech, or threatening communications
• Content that violates any applicable federal, state, or local law

6. Identification Certificates

Identification certificates issued through the Platform are informal, photo-based assessments for educational and informational purposes only. They are NOT professional gemological appraisals, certifications of authenticity, or legally binding opinions. KillerRocks, its staff, and its verified gemologists expressly disclaim liability for any reliance on identification certificates for commercial, legal, insurance, or financial purposes. 7. Platform Fees

KillerRocks charges fees on certain transactions as disclosed at the time of transaction. Fees are non-refundable except as required by applicable law. We reserve the right to modify fee structures with 30 days' notice.

8. Verified Status

Verified Gemologist and Master Artisan status is granted at the sole discretion of KillerRocks staff and may be revoked at any time. Verification indicates staff review of submitted credentials; it does not constitute endorsement of any specific claim, identification, or item. Users are encouraged to exercise independent judgment.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, KILLERROCKS LLC, ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM YOUR USE OF OR INABILITY TO USE THE PLATFORM, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

Our total cumulative liability to you for any claims arising under these Terms shall not exceed the total fees paid by you to KillerRocks in the twelve (12) months preceding the claim.

10. Indemnification

You agree to indemnify, defend, and hold harmless KillerRocks LLC and its affiliates from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or in any way connected with your use of the Platform, your violation of these Terms, or your violation of any third-party rights.

11. Dispute Resolution

Any dispute arising from these Terms shall first be attempted to be resolved through good-faith negotiation. If unresolved within 30 days, disputes shall be resolved through binding arbitration under the rules of the American Arbitration Association, conducted in the State of [Your State], USA. Class action waiver: you agree to resolve disputes individually, not as part of a class action.

12. Governing Law

These Terms are governed by the laws of the United States and the State of [Your State], without regard to conflict of law provisions.

13. Changes to Terms

We reserve the right to modify these Terms at any time. Continued use of the Platform after changes constitutes acceptance. Material changes will be communicated via site announcement or email.

14. Shipping Policy

KillerRocks ships physical goods purchased through the KillerRocks Store. The following terms apply to all store purchases:

• Processing Time: Orders are processed within 1–3 business days of payment confirmation. Orders placed on weekends or holidays are processed the next business day.
• Shipping Carriers: We ship via USPS, UPS, FedEx, and DHL depending on item size, weight, destination, and service availability. Carrier selection is at our discretion unless a specific carrier is requested and feasible.
• Shipping Cost: Shipping costs are calculated at checkout based on destination, weight, and dimensions. Free shipping may be offered on qualifying orders.
• Domestic Delivery: Standard domestic shipments within the United States typically arrive within 3–7 business days after processing. Expedited options may be available.
• International Shipping: International shipments are subject to customs review in the destination country. The buyer is solely responsible for all customs duties, import taxes, and associated fees. KillerRocks accurately declares the full value of all shipments on customs forms as required by law. We cannot mark packages as "gifts" or undervalue contents.
• Fragile & High-Value Items: Mineral specimens, meteorites, fossils, and other fragile or high-value items are professionally packed with appropriate protective materials. We reserve the right to require signature confirmation on orders exceeding $100 USD.
• Insurance: Orders valued over $100 USD may be insured at our discretion. For high-value specimens (over $500), we strongly recommend purchasing additional shipping insurance; contact us before checkout to arrange.
• Tracking: A tracking number will be emailed and posted to your order page when your shipment is scanned by the carrier. Tracking may take up to 24 hours to become active after the label is created.
• Undeliverable Packages: If a package is returned to us as undeliverable due to an incorrect address provided by the buyer, we will contact you. Re-shipment will require payment of a new shipping fee.
• Lost or Damaged Shipments: If your order arrives damaged or does not arrive within the estimated delivery window, contact us at support@killerrocks.com with your order number. We will work with the carrier to resolve the issue and make it right.

15. Refund & Return Policy

We want you to be completely satisfied with your purchase. Please read this policy carefully before placing an order.

Store Orders (Physical Goods)

• Return Window: Items in original, undamaged condition may be returned within 14 days of the date of delivery for a full refund of the purchase price, minus original shipping cost (unless the return is due to our error).
• Condition: Items must be returned in the same condition as received, with all original packaging materials. Items that have been damaged, altered, or used outside normal examination may not be eligible for return.
• Return Shipping: The buyer is responsible for return shipping costs unless the item was received in error or arrived materially different from its description. We recommend insured, tracked shipping for all returns.
• Damaged on Arrival: If your item arrives damaged, photograph the packaging and item immediately upon receipt and contact us within 48 hours at support@killerrocks.com. We will arrange a replacement or full refund including shipping.
• Not as Described: If an item significantly differs from its description or photographs, contact us within 7 days of delivery. We will fully refund the purchase price and original shipping upon return of the item.
• Initiate a Return: Email support@killerrocks.com with your order number, reason for return, and photographs if applicable. Do not ship items back without first receiving a return authorization.

Digital Items & Forum Gold (FG)

• Forum Gold purchases and digital in-platform currency are non-refundable once credited to your account, except where required by applicable law.
• Virtual game items, loot box contents, and in-game purchases are final sale.
• If a technical error results in incorrect crediting or a double charge, contact us immediately and we will correct it.

Marketplace (User-to-User Sales)

KillerRocks is a venue for peer-to-peer transactions in the Marketplace. Refund and return terms for Marketplace sales are set between buyer and seller. KillerRocks does not mediate payment disputes between users but may investigate reports of fraud or misrepresentation at our discretion.

Processing Time

Approved refunds are processed within 5–10 business days to the original payment method. Stripe-processed refunds typically appear within 5–7 business days depending on your bank. Forum Gold refunds are credited instantly.
